EverEcho Ltd ("EverEcho", "we", "us", "our") is a company registered in England and Wales. We provide a digital memorial platform that enables families to create and host permanent online memorials for deceased persons ("the Service").
By registering an account or purchasing any EverEcho product, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.
You must be at least 18 years old and resident in the United Kingdom to use the Service. By agreeing to these Terms, you confirm that you meet these requirements.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate, current, and complete information during registration and keep it up to date.
EverEcho reserves the right to suspend or terminate accounts that violate these Terms or that we believe are being used fraudulently.
You retain ownership of all content you upload to EverEcho (photographs, text, video). By uploading content, you grant EverEcho a non-exclusive, worldwide, royalty-free licence to store, display, and deliver that content solely for the purpose of operating the Service.
You must not upload content that:
EverEcho reserves the right to remove content that breaches these restrictions without notice, and may report illegal content to the appropriate authorities.
All prices are quoted in pounds sterling (GBP) and include VAT where applicable. Our memorial packages are sold as one-time payments — there are no recurring subscription charges. Payment is processed securely by Stripe; EverEcho does not store card details.
You have a statutory right to cancel within 14 days of purchase (the "cooling-off period") under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, unless you have requested us to begin providing the Service immediately (in which case a proportionate charge may apply). Outside the cooling-off period, payments are non-refundable except at EverEcho's sole discretion.
EverEcho is committed to hosting all published memorials in perpetuity. A hosting reserve fund is maintained from a portion of each order to ensure continuity. In the event that EverEcho ceases to operate, we will:
The EverEcho name, logo, and platform design are the intellectual property of EverEcho Ltd. You may not reproduce, distribute, or create derivative works from any part of the platform without our prior written consent.
To the maximum extent permitted by UK law, EverEcho's total liability to you for any claim arising under these Terms shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
EverEcho is not liable for any indirect, consequential, or special loss, including loss of data, loss of profits, or emotional distress. Nothing in these Terms excludes or limits liability for death, personal injury, or fraud caused by our negligence.
Your personal data is processed in accordance with our Privacy Policy, which forms part of these Terms. EverEcho complies with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
We may update these Terms from time to time. We will notify you by email at least 30 days before any material change takes effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.
These Terms are governed by the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to your statutory consumer rights.
